Code violation cases in the City of Port St. Lucie are overseen by a Special Magistrate, who is an attorney and/or retired judge appointed by the City Council. The Special Magistrate has the authority to hear and decide on alleged violations, exercising the powers outlined in Chapter 162 of the Florida Statutes. This includes subpoenaing individuals and records, ruling on violations, assessing fines, and placing liens on properties.

The Code Compliance Division aims to bring properties into compliance with city codes. Property owners cited by a Code Compliance Specialist are given a reasonable amount of time to address violations before being referred to the Special Magistrate.

If violations persist after a case is heard by the Magistrate, daily fines may be imposed, potentially resulting in a city-imposed lien on the property’s title. Severe violations threatening public health and safety may lead to public nuisance proceedings, with the city correcting the issue at the property owner's expense.

Once all code violations are corrected, property owners may apply for a Modification or Partial Release of a Lien under certain conditions.
